Website Status Notice

The website is currently an informational and business-inquiry site. It does not permit visitors to create accounts, upload customer diligence materials, hold balances, connect wallets, or initiate payments, conversions, settlements, or other transactions. Any future services will require separate agreements, onboarding, provider approval, and applicable legal and compliance review.

1. Acceptance of These Terms

These Website Terms of Service (the “Terms”) govern access to and use of https://finenze.com and any related webpages, contact forms, content, and public-facing features operated by Finenze LLC, a Wyoming limited liability company (“Finenze,” “we,” “us,” or “our”) (collectively, the “Site”).

By accessing or using the Site, or by submitting information through the Site, you acknowledge that you have read and agree to these Terms. If you do not agree, do not use the Site.

2. About Finenze and the Site

Finenze is developing payment and digital asset infrastructure for businesses through approved third-party financial and technology providers. The Site is intended to describe Finenze, present anticipated business capabilities, and facilitate initial business inquiries.

Content describing payment, conversion, settlement, virtual account, digital asset, stablecoin, wallet, application programming interface (“API”), compliance, or related functionality may concern services that are in development, available only through third parties, or subject to future approval. Website descriptions are not a commitment that any particular feature, asset, rail, jurisdiction, price, settlement time, service level, or provider relationship is currently available.

3. No Account or Transaction Services Through the Site

The Site does not currently allow visitors to create user accounts or profiles, upload identification or financial documents, connect wallets, receive virtual account credentials, hold funds or digital assets, or initiate or manage any payment, exchange, conversion, settlement, custody, or transaction activity.

Submitting a contact form or communicating with Finenze through the Site does not create a customer, merchant, bank, custodial, fiduciary, money transmission, payment processing, advisory, or other financial services relationship.

4. Separate Agreements and Third-Party Providers

Any actual products or services made available by Finenze or through a third-party provider, including payment, settlement, virtual account, stablecoin, digital asset, wallet, custody, conversion, API, KYC/KYB, compliance, fraud prevention, or card-related services (collectively, “Platform Services”), will be governed by separate written agreements, order forms, provider terms, privacy notices, pricing schedules, onboarding standards, risk disclosures, and approvals.

Regulated functions may be performed by appropriately authorized banks, money transmitters, custodians, payment processors, digital asset service providers, identity verification providers, compliance vendors, or other third parties. Their services may be subject to separate eligibility requirements, geographic limitations, operating rules, fees, holds, reserves, transaction limits, and suspension or termination rights.

If these Terms conflict with a signed agreement governing Platform Services, the signed agreement controls with respect to those Platform Services.

5. Eligibility and Authority

The Site is intended primarily for business, institutional, and professional users. You must be at least 18 years old and legally capable of agreeing to these Terms. You may not use the Site if applicable law prohibits you from doing so.

If you use the Site on behalf of a company or other organization, you represent that you are authorized to act for that organization and to bind it to these Terms.

6. Contact Forms and Electronic Communications

The Site contact form currently requests your name, email address, and message. By submitting the form, you authorize Finenze and its service providers to process the submission and to contact you regarding your inquiry. Submission of a form does not guarantee a response, onboarding, approval, or access to any product or service.

You are responsible for ensuring that information you submit is accurate, current, and lawful. You may not submit information concerning another person unless you are authorized to do so.

7. Do Not Submit Confidential or Sensitive Information

The public contact form is not intended for confidential, privileged, regulated, or highly sensitive information. Do not submit passwords, private keys, seed phrases, government identification numbers, tax identification numbers, bank account credentials, payment card information, medical information, or other sensitive personal or financial information through the Site.

Information submitted through the public Site does not create a confidentiality obligation except to the extent required by applicable law or expressly provided in a separate written confidentiality agreement. Our handling of personal information is described in the Privacy Policy.

8. Onboarding, Compliance, and Business Acceptance

Before Platform Services are made available, Finenze and applicable providers may require business verification, KYC or KYB review, beneficial ownership and control-person information, sanctions and politically exposed person screening, adverse media review, fraud screening, source-of-funds information, expected activity, invoices, transaction documentation, and other due diligence.

Finenze or a provider may decline, delay, condition, limit, suspend, or terminate onboarding, access, or a business relationship for legal, regulatory, compliance, underwriting, fraud prevention, security, operational, reputational, or business reasons. No website statement limits those rights.

9. Prohibited Uses

You may not use the Site, attempt to access the Site, or use information obtained through the Site to:

  • •violate any law, regulation, sanctions restriction, export control, court order, or contractual obligation;
  • •provide false, misleading, fraudulent, inaccurate, or incomplete information;
  • •impersonate another person or entity, misrepresent your authority, or conceal the true purpose or beneficiary of an activity;
  • •engage in fraud, money laundering, terrorist financing, sanctions evasion, theft, ransomware, unlawful gambling, trafficking, market manipulation, or other illegal activity;
  • •interfere with, disrupt, overload, scan, probe, scrape, crawl, reverse engineer, or attempt to gain unauthorized access to the Site or connected systems;
  • •introduce malware, malicious code, automated requests, or other technology that may damage or compromise the Site; or
  • •infringe intellectual property, privacy, publicity, confidentiality, or other rights of Finenze or any third party.

10. No Offer; Information May Change

Site content is general information only. It is not an offer, solicitation, commitment, representation, or guarantee to provide any financial product or service, enter into any transaction, accept any customer or merchant, support any asset or jurisdiction, or provide any particular price or commercial term.

Finenze may change, correct, remove, or update Site content at any time. Content may become outdated, incomplete, or inaccurate, and you should not rely on Site content as the sole basis for a business, legal, financial, compliance, or investment decision.

11. Digital Asset and Payment Risks

Digital assets, stablecoins, blockchain networks, payment rails, virtual accounts, wallet systems, custodians, banks, and conversion providers involve significant legal, operational, market, technology, counterparty, and compliance risks. Depending on the service and provider, transactions may be irreversible, delayed, rejected, recalled, frozen, restricted, re-routed, or unavailable. Fees, gas costs, spreads, exchange rates, liquidity, settlement timing, and supported assets may change.

Digital assets and stablecoins may experience volatility, loss of value, depegging, issuer or reserve risk, smart contract vulnerabilities, network congestion, forks, cybersecurity incidents, sanctions restrictions, or changes in law. Identity verification, liveness checks, transaction documentation, and wallet-based flows may reduce certain fraud or dispute risks, but they do not eliminate chargebacks, reversals, returns, recalls, fraud claims, bank holds, compliance reviews, law enforcement action, or loss.

Unless a separate signed agreement expressly states otherwise, Finenze does not guarantee availability, uninterrupted operation, execution quality, best pricing, exchange rates, transaction completion, settlement timing, account availability, provider approval, recovery of digital assets, or any particular regulatory treatment.

12. No Professional Advice

The Site does not provide legal, tax, accounting, investment, securities, commodities, banking, compliance, regulatory, or other professional advice. You should consult qualified independent advisors before making decisions involving payments, digital assets, business structure, tax, compliance, or regulated activity.

13. Third-Party Services and Links

The Site may depend on or link to third-party hosting, form-processing, email, font, financial, technology, or other services. Third parties operate under their own terms, privacy notices, security practices, and service limitations. Finenze does not control and is not responsible for third-party websites, services, content, availability, conduct, or security, except to the extent responsibility cannot be excluded under applicable law or is expressly accepted in a signed agreement.

14. Intellectual Property

The Site and its text, design, graphics, logos, names, interfaces, code, arrangement, and other content are owned by Finenze or its licensors and are protected by intellectual property and other laws. All rights not expressly granted are reserved.

Finenze grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Site for lawful informational and business-inquiry purposes. You may not reproduce, modify, distribute, sell, license, create derivative works from, publicly display, frame, mirror, reverse engineer, or commercially exploit the Site or its content without Finenze’s prior written permission, except as permitted by law.

15. Feedback

If you voluntarily provide ideas, suggestions, feature requests, or other feedback, you grant Finenze a perpetual, irrevocable, worldwide, royalty-free right to use and incorporate that feedback without restriction or compensation. Finenze will not publicly identify you as the source without permission unless required by law.

16. Privacy and Security

The Privacy Policy describes how Finenze collects, uses, discloses, and protects personal information associated with the Site. It is incorporated into these Terms by reference.

Finenze and its service providers use measures designed to protect the Site and information submitted through it. No website, transmission, storage system, or security control is completely secure. You use the Site and transmit information at your own risk and should use secure devices, networks, and communication channels.

17. Site Availability and Changes

Finenze may modify, suspend, restrict, or discontinue any part of the Site at any time, with or without notice. Finenze has no obligation to maintain any content, feature, link, or functionality or to provide support, uptime, maintenance, or service-level commitments for the public Site.

18. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINENZE DISCLAIMS ALL EXPRESS, IMPLIED, STATUTORY, AND OTHER WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, SECURITY, RELIABILITY, AVAILABILITY, AND ERROR-FREE OR UNINTERRUPTED OPERATION. FINENZE DOES NOT WARRANT THAT THE SITE WILL MEET YOUR REQUIREMENTS, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR ITS SERVERS ARE FREE OF HARMFUL COMPONENTS.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINENZE AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, DIGITAL ASSETS, OR USE, ARISING FROM OR RELATED TO THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF FINENZE AND THE FOREGOING PERSONS ARISING FROM OR RELATED TO THE PUBLIC SITE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID DIRECTLY TO FINENZE, IF ANY, SOLELY FOR USE OF THE PUBLIC SITE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limitations do not apply to liability that cannot be limited or excluded under applicable law. Separate agreements may contain different risk allocations for Platform Services.

20. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Finenze and its members, managers, officers, employees, contractors, and affiliates from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your unlawful or unauthorized use of the Site, your violation of these Terms, information you submit, or your infringement of another person’s rights. Finenze may control the defense and settlement of any matter subject to indemnification, and you agree to cooperate reasonably.

21. Governing Law and Forum

These Terms and any dispute arising from the public Site are governed by the laws of the State of New York, without regard to conflict-of-law rules. Subject to any mandatory law, the state courts located in Nassau County, New York, and the United States District Court for the Eastern District of New York will have exclusive jurisdiction. You consent to personal jurisdiction and venue in those courts.

22. Changes to These Terms

Finenze may update these Terms by posting a revised version on the Site and changing the “Last Updated” date. Changes apply prospectively when posted unless a later date is stated. Continued use of the Site after an update constitutes acceptance of the revised Terms.

23. General Terms

These Terms and the Privacy Policy constitute the entire agreement between you and Finenze concerning the public Site, except for any separate written agreement. If a provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without Finenze’s written consent. Finenze may assign these Terms in connection with a merger, reorganization, financing, sale of assets, or similar transaction.
